The Republican reform of the Bankruptcy Code was so ANTI-CONSUMER and PRO-BANK...that great injustices are being done to the American working consumer...
One of the first things the new Democratic Congress might want to do is correct some of the more blatant wrongs done to endebted consumers by the code changes of last year...
For example the "means test" might be raised to 150% of the state's average wage...
And the penalties against persons who merely prepare bankruptcy forms...could to eased.
Chapter 13's almost never work out... So forcing people who should be in Chapter 7 into a Chater 13 is not benefiting anyone...especially not the banks and credit card companies.
Now that the new statute has been in effect for over a year....the "bugs" have been discovered...and they should be corrected by the Democrats ASAP.
