One factor that is highly OVERRATED on the Supremem Court is this notion of "GENIUS."

The Constitution has about a HALF DOZEN "PHRASES" THAT ARE CONSTANTLY BEING "INTERPRETED"...If the Court finds in your favor they are "correct" if the Court finds against you? They are: "Legislating from the Bench!" Any questions?
The main phrases that are "interpreted" are (in no order): DUE PROCESS. EQUAL PROTECTION. THE COMMERCE CLAUSE. FIRST AMENDMENT FREE SPEECH. AND NOTIONS LIKE "HEALTH, SAFETY AND WELFARE" AND my personal favorite: "COMPELING STATE INTEREST."
SO CONSTITUTIONAL LAW IS REALLY MORE ABOUT THE HEART THAN THE HEAD...
Do you believe in the "Experiment of Federalism" wherein the States are allowed to make mistakes and do "social experiments" to see what works and what doesn't...or are we all going to be bound by some rigid doctrinal policy handed down in Washington?
Do you believe that the Constitution should grow and expand to fit the times? Or are crack pot "amendments" always going to be necessary? (And we've had many!)
Do you believe in Individual Rights...or is Social Control by the State paramount?
SO THE SUPREME COURT IS MORE ABOUT HEART THAN HEAD... FRANKLY, I AM HIGHLY SUSPICIOUS OF THESE SO-CALLED "LEGAL GENIUSES" LIKE ROBERTS.
MS. MIERS MAY BE A "LEGAL LIGHT WEIGHT" BUT THE REAL QUESTION SHOULD BE: WHERE IS HER HEART...NOT HER HEAD. IVY LEAGUE LAW SCHOOLS ARE STUFFED WITH A-HOLES WHO COULD RIP THIS COUNTRY APART WITH THEIR "GENIUS!"
